1.         DEFINED TERMS 

1.1       In these terms;  

                “Account” has the meaning as set out in Section 2.1 below.                             

“Terms” means the general terms of this programme. 

“Gift Card” means a McElhinney’s Gift Card purchased at McElhinney, Ballybofey or online at www.mcelhinneys.com

“In Store” means McElhinney’s Stores, Main Street, Ballybofey, Co Donegal. 

“Loyalty Card” means the physical M-card which can be used at McElhinney Stores, Main Street, Ballybofey, Co Donegal. 

“Member” means the holder of an account. 

“Partnership Card” refers to the previous Loyalty programme operated by McElhinneys which ceased on the 31st January 2022. 

“Points” has the meaning set out in Section 4. 

“Promoter” means John McElhinney Unlimited Company trading as McElhinney’s Stores, Main Street, Ballybofey, Co Donegal. 

“Programme” means the McElhinney Loyalty Programme described as the M-card Loyalty Programme. 

“Year” means a calendar year running from 1 January until 31 December. 

 

2.         THE PARTIES 

 

2.1          The promoter of the programme is John McElhinney Unlimited Company, Main Street,

Ballybofey, Co Donegal, Company Registration Number: 54692 trading as McElhinney (hereinafter referred to as McElhinney’s)

2.2          A Member is any person who has applied for and has been granted a Loyalty M-card by McElhinneys, Main Street, Ballybofey, Co Donegal.  

2.3          To become a Member an applicant must become a registered account holder by creating an account and completing a hard copy registration form and submitting it in-store at McElhinney’s. Once the account is created and validated by McElhinney’s the loyalty account becomes active. 

2.4          Certain members of the previous partnership card programme operated by McElhinneys, who had an active spend on their account between the years 2018, 2019 and the first 2 months of 2020 will be automatically entitled to an M-Card.

2.6          Members are responsible for reading and understanding the Loyalty Programme terms and conditions and other communication received from the Company about the Loyalty Programme in order to understand his/her/their rights, responsibilities and status in the Loyalty Programme.  If a Member has any questions about the Loyalty Programme or the Programme terms and conditions, a member should contact [email protected] or call us on 00353 74 9131217 

2.7          Members are responsible for reading the Company’s Privacy Statement available at www.mcelhinneys.com/loyalty in order to understand how the Company collects, uses and discloses a Member’s data.  If a Member has any questions about the Company’s Privacy Policy, its collection, use or disclosure of a Member’s data, the Member should contact [email protected] or call us on 00353 74 9131217.  

3.         GENERAL 

3.1          This section explains the terms of use on which we operate our loyalty programme and how you can use your M-Card Instore only. Reference in these Terms and Conditions to “we”, “us”, “our” and “McElhinney’s” refers to John McElhinney UC, Main Street, Ballybofey, Co. Donegal. Company Registration Number: 54692.  

3.2          The McElhinney’s M-Card is the property of McElhinney’s and it must be promptly returned to McElhinney’s or destroyed if so requested by McElhinney’s. 

3.3          In the event that a McElhinney’s M- Card is damaged, lost or stolen, McElhinney’s will charge a €20 admin fee for a replacement card. Replacement cards can be obtained & registered In-store. McElhinney’s does not accept any liability for lost, stolen or damaged Loyalty Cards. 

3.4          The McElhinney’s M-Card is not a credit, payment or cheque guarantee card. 

3.5           McElhinney’s may amend these Terms at their discretion. McElhinney’s may notify Members of any changes to these Terms. If a Member uses their M-Card following a change in the programme the Member will be deemed to have accepted the change. McElhinney’s may revoke membership of the Programme at any time and if so, any points the Member has accumulated with McElhinney’s in respect of the programme will be forfeited. In each case, McElhinney’s will not be liable for any resulting loss or damage. 

3.6          Members must present a McElhinney’s M-Card, when making a purchase in order to earn points on that purchase.  

3.7          Members must personally present their card when making a purchase in store. Cards cannot be shared or transferred 

3.8          All Members must be at least 18-years-old on the date of creation of their account. 

3.9          When purchasing a gift card, members will not receive points on the purchase of a gift card, only when the gift card is being redeemed points will be added to a loyalty card.

3.10        McElhinney’s reserves the right to exclude allocation of points to brands and departments as they see fit. 

 3.11       Members can redeem points on the purchase of sale reduced goods

3.12        Members cannot earn points on the purchase of Sale reduced goods.

3.13        Membership is tiered according to each member’s spend and each tier of membership offers enhanced benefits. McElhinney’s reserves the right to change a member’s tier at its discretion where the member’s spend substantially decreases or does not reach the annual spend as stated. 

3.14        The member is obliged to notify McElhinney’s in writing of any change in the member’s address or other member details.   

3.15        The allocation of points will be added to your M-Card on final payment to item(s) placed on deposit  

3.16        Points cannot be redeemed or earned in McElhinneys Bridal Rooms

 

4.            THE THREE TIERS OF THE M-CARD LOYALTY PROGRAMME 

4.1          Membership is tiered according to each member’s combined spend with McElhinney’s. McElhinney’s reserves the right to change a member’s tier at its discretion where the member’s spend substantially decreases 

If a member spends more than €5,000 within a calendar year they will start to earn 150 points for every €10 they spend at the start of the new calendar year. If a member spends more than €12,000 within a calendar year they will start to earn 200 points for every €10 they spend at the start of the new calendar year 

4.2          You will automatically upgrade to each tier as you spend on an annual basis. Points collected must be redeemed within 24 months. Unredeemed points will be removed from your M-Card if not redeemed within these 24 months 

4.3          Points can only be redeemed once your McElhinney’s M-Card account has been activated but however you can start collecting points straight away.  

4.4          McElhinney’s may also offer bonus points in its absolute discretion at certain times. Members can check their points balance instore at any till point. 

4.5          Members may redeem points subject to all applicable laws and regulations and subject also to income tax and other taxes which shall be the sole liability and responsibility of the member. McElhinney’s does not accept any liability for points (as defined below) accrued on or redeemed from the loyalty card without the member’s knowledge. 

4.6          McElhinney’s, at its discretion, suspend, alter, amend or terminate the programme at any time on giving reasonable notice to the members, which notice may be given online, by letter, through email communication to the members or by displaying notices In-store.

4.7          Tier 1 Membership is open to all customers without a minimum spend. Tier 2 Membership applies to members who have spent over €5000 in a calendar year. Tier 3 Membership applies to members who have spent over €12,000 in a calendar year.  

Tier 2 Membership will be retained for a full year once the member meets the allocated tier criteria of €5,000 spend in the previous calendar year. 

Tier 3 Membership will be retained for a full year once the member meets the allocated tier criteria of €12,000 spend in the previous calendar year. 

5.            OPERATING THE PROGRAMME 

Earning Points 

5.1          Points can be earned by members on purchases In-store

5.2          Points cannot be earned by members: 1) on the purchase of a gift card/s; 2) on delivery charges; 3) on In-store gratuities; 4) on In-store alterations; 5) on points redeemed; 6) postage; 7) in McElhinneys Bridal Rooms

5.3          Members earn 100 points for every €10 spent on (Tier 1), 150 points for every €10 (Tier 2), 200 points for every €10 spent on (Tier 3). Points earned on in-store transactions will be applied to a member’s account and available to spend immediately instore once membership is activated. 

Redeeming Points 

5.4          Members can only redeem points In-store for the time being. If your card is not present on the day of purchase no points can be added. You can add points from previous receipts up to 7 days after purchase. 

5.5          Points cannot be exchanged or redeemed for cash at any time. 

5.6          McElhinney’s has the right at its sole discretion to determine from time to time which products and services qualify for points and the number of points that will be credited for a transaction. 

5.7          Points have no monetary value and cannot be sold, transferred or otherwise dealt with except in accordance with these terms. 

Returns/Refunds/Deposits                                                                        

5.8          On the return of an item that earned points, the number of points earned on that transaction shall be deducted from member’s account balance. The deduction will occur when a refund is completed in-store in accordance with McElhinney’s returns and refund policies.  

5.9          If a member has redeemed points towards the payment (full or part payment) of an item that is subsequently returned in accordance with McElhinney’s returns policy these Points will be credited back on to the account at the time of the completion of the return of the item. 

5.10        If a member has paid a deposit on an item, the allocation of points will be added to your M-Card on payment completion on any item on deposit. 

Points Expiry 

5.11        Points collected must be redeemed within 2 calendar years, or any part of a year concluding at the 31 December each year, with the M-Card Loyalty Programme running from 1 January until 31 December.  Unredeemed points will be removed from your M-Card if not redeemed within this time. 

Points Transfer 

5.12        Points cannot be transferred between accounts or donated towards social causes. For the avoidance of doubt, replacement of a lost or stolen McElhinney’s Loyalty Card does not result in the creation of a new account for the member. Member may request a replacement McElhinney’s Loyalty Card which will then need to be linked to the member’s existing account. This can be done by calling instore to discuss with a member of our Loyalty team. 

Allocation of Retrospective Points 

5.13        The Member is obliged to notify McElhinney’s in writing of any change in the member’s address or other member details, by contacting a member of our Loyalty team instore. 

5.14        Members must present a McElhinney’s M-Card, when making a purchase in order to earn or redeem points on that purchase. If your card is not present on the day of purchase no points can be added. You can add points from previous receipts up to 7 days after purchase. 

Cancellation or Suspension of a Membership Account by the Promoter

5.15        The Promoter may cancel a Member’s accumulated points, suspend the Loyalty Programme benefits, with immediate effect and without written notice for any reason and at the Promoter’s sole discretion, including, without limitation, if the Company believes the Member has: 

(a)    acted in a manner inconsistent with applicable laws and regulations;

(b)                  acted in an inappropriate, fraudulent, abusive or hostile manner;  

(c)  breached or violated any of the Programme’s Terms and Conditions;  

(d)  fraudulently claimed eligibility to earn points;  

(e)  engaged in any misconduct or any wrong doing in connection with the Loyalty Programme. 

 

Effective Membership Cancellation 

5.16        The Loyalty Programme points and other related benefits and services are the sole

property of the Promoter and are not the property of the Members.  On cancellation of membership in the Loyalty Programme for any reason, all unredeemed points will be forfeited and the Member will no longer be able to participate in the Loyalty Programme and the Company will not compensate or pay cash for any forfeited or unused points.   

5.17        If the Promoter cancels a Member’s account for any reason, the Member may not reapply for membership in the Loyalty Programme, except in very limited circumstances at the Promoter’s sole discretion and any account opened in the Member’s name and points earned in that account will be forfeited upon discovery. 

5.18        If a Member cancels his or her account or becomes inactive, the Member may reapply for membership in the Loyalty Programme at a later date but no points previously forfeited or expired will be reinstated to the Member’s account.   

5.19        Previous Partnership Loyalty Programme 

The M-Card Loyalty Programme replaces and supersedes the Partnership Loyalty Programme operated by McElhinney Stores up until 31st January 2022.  All partnership card benefits will cease on the 31st January 2022. 

Certain members in possession of a Partnership Card who have had an active spend between the years 2018, 2019 and the first 2 months of 2020 will be allocated a new M-Card. Those Members who have not been allocated an M Card due to their inactive account, can make an application for an M Card. 

5.20        Programme Termination 

By the Member 

5.20.1    You can cancel your subscription to the Loyalty Programme at any point by contacting [email protected] 

Account Deletion                                            

5.20.2    Erased all points collected up to that date which will become unrecoverable.  In the case that you want to keep your account but want to stop receiving email notification, you can unsubscribe from our mailing list by sending an email to [email protected] 

By the Company 

5.20.3    John McElhinney Unlimited Company may cancel the Loyalty Programme at any point in time at their discretion, in which case, no liability or compensation shall be offered to the members.   

 

6.            DATA PROTECTION NOTICE 

6.1          Personal data supplied to McElhinney’s (e.g. name, address, email, telephone number) by a Member during the registration process will only be processed by McElhinney’s for the purposes set out below and in accordance with our Privacy Policy. Other than as stated below, no personal data will be divulged to any third parties outside of McElhinney’s or its data processors, unless required by law, or in order for us to comply with our legal and regulatory obligations or the protection of our interests or for defence against a legal claim. 

6.2          Accounts and transactions may be monitored in order for us to comply with our legal and regulatory obligations. 

6.3          McElhinney’s can use the personal data supplied by the Member in order to manage and administer the Programme and improve the way the Programme is run; to help McElhinney’s understand Members’ shopping habits; to communicate information to Members; and to provide Members with relevant tailored offers by email, SMS or post, unless the Member opts out of the receipt of such offers in accordance with the Privacy Policy  

6.4          McElhinney’s can also use information relating to sets or groups of Members, without identifying Members, to enhance its understanding of Member behaviour and enable McElhinney’s to improve its service in general. 

6.5          A Member can 'opt out' of such marketing communications at any time, free of charge, if he/she/they does not want to be contacted by McElhinney’s for direct marketing purposes, by ticking the appropriate box on the Registration Form or contacting a member of our loyalty team. 

6.6          Any request by a Member for a copy of their data must be made, in writing, to McElhinney Stores, Main Street, Ballybofey, Co Donegal.   

6.7          It is important that Members’ personal data is kept up to date in order for McElhinney’s to operate the Programme effectively. If a Member wishes to change or update Member’s personal data on his/her/their Account, Member can do so by calling instore to discuss with one of our loyalty team members. 

6.8          Any information provided by you in the Registration Form or gathered by McElhinney’s during any visits to the Programme website shall be subject to the terms of the McElhinney’s Privacy Policy which can be accessed on www.mcelhinneys.com

7.            LEGAL NOTICE  

7.1          From signing the hard copy registration form, or the first use of the M-Card, the Members agreement to these Terms and Conditions are implied. 

7.2          These Terms and Conditions are governed by the Irish Laws and the Courts of the Republic of Ireland have jurisdiction in relation to this Agreement. 

8.             SEVERABILITY 

8.1          If any of the Terms and Conditions contained herein affirm to be invalid, unenforceable or illegal, then that term will be deemed to be severed from the Agreement and the balance of the Terms and Conditions will remain enforceable. 

8.2          McElhinney’s will have no liability to each member for any loss, damage and either contract or otherwise in connection with the operation of the Loyalty Programme. 

9.            MARKETING COMMUNICATIONS 

By accepting and using your M-Card, you agree and give permission to McElhinney Stores to send you relevant emails, including but not limited to information about the Loyalty Programme, promotional offers of new or existing products and updates regarding the registration of the Programme.
